Brazil — allotment, law and dispensaries

Ivy's summary of the rules in force now, with a link to the official program.

Brazil allotment

AllotmentMedical patients only

There is no specific national gram-based monthly limit for patients; instead, access is determined by the quantity prescribed by a physician for the patient's specific medical condition. Patients may obtain products through registered pharmacies or, in some cases, through authorized patient associations that have received regulatory approval to cultivate and distribute.

  • Access is strictly limited to registered patients with a valid medical prescription.
  • Quantity is determined by the physician's prescription based on the patient's therapeutic needs.
  • Patients may access products via commercial pharmacies or authorized patient associations.
  • Personal home cultivation is not generally permitted for individuals; cultivation is restricted to authorized legal entities and patient associations.

Cannabis law in Brazil

Legal — medical use

Brazil operates a national medical cannabis programme regulated by Anvisa, which allows for the manufacture, import, and commercialization of cannabis-based products for human medical use. Patients qualify for treatment based on medical necessity and must obtain a prescription from a qualified healthcare professional to access authorized products through pharmacies or patient associations.

  • Patients must have a medical prescription to access cannabis-based products.
  • Products are available through pharmacies and authorized patient associations.
  • Anvisa regulates the entire production chain, including cultivation for medical and research purposes.
  • The regulatory framework (RDC 1.015/2026) governs the quality, safety, and advertising of medical cannabis products.
  • Recreational use of cannabis remains illegal in Brazil.
